Advance Directives

The Federal Patient Self-Determination Act of 1990 requires hospitals to inform patients of their legal rights to refuse or accept medical treatment if they become incapacitated.

In California, the legally recognized document for ensuring your rights is the Advance Directive. This document lets you name another person to make medical decisions on your behalf in the case that you cannot speak for yourself. An Advance Directive can help ensure that your wishes regarding medical treatment are honored.

The Advance Directive is the new format for the Natural Death Act Declaration, or living will, in California. It also supersedes the Durable Power of Attorney for Health Care (DPAHC) for appointing a health care agent. A DPAHC executed before 1992 has expired and should be replaced with an Advance Health Care Directive. All other DPAHCs and Natural Death Act Declarations remain valid. Keep in mind, however, that Advance Directives give you more flexibility to state your health care preferences, so you may wish to complete a new form anyway.

Before stating your health care preferences in writing, you may want to discuss them with your family, physician, spiritual counselor, or attorney. To get an Advance Directive Kit, contact our Social Services Department at 818-375-2977.

We have also implemented many services that meet or exceed local, state, and national regulations.
